Divorce records

A divorce record documents the Islamic dissolution of a marriage by Talaq, Khulu' or Faskh. Where a civil court has dissolved the marriage, the record rests on its decree. Where none has, because the marriage was never civilly registered or no civil case was brought, the reviewing scholar interviews the parties before the facts are confirmed.

With a civil decree

Where a civil court has dissolved the marriage, the application includes the decree signed by the judge. The reviewer checks the case number, the court, the judge and the dates against it, and the Effective Date of the Islamic dissolution is thirty days after the judge signed.

Without a civil decree

Where the marriage was never civilly registered or no civil case was brought, the application includes the marriage contract or the nikah certificate, and the reviewing scholar interviews the parties before confirming the facts. The Effective Date is the date of the act: the date the Talaq was pronounced, or the date the release was agreed in a Khulu', as both spouses attest it, or for a Faskh the date of the scholar's ruling.

What every application requires

Both spouses sign the certificate, together with two witnesses, and each signs through a separate link sent by email. Cases in which one spouse will not take part are not yet accepted. The questions cover the dates of the marriage and the separation and the way the settlement, the debts, the property and the bride-purse (mahr) were handled, and the answers are saved as they are entered, so an application can be left while a document is found and resumed later.
